Nathan Kinsella and his partner, who are both due to go on trial at the Special Criminal Court over alleged money laundering offences, have been additionally charged with failing to furnish tax returns.

Mr Kinsella (44) and Jennifer Dunne (38), both of Richmond in Blackrock, Co Dublin, were each re-charged on Tuesday with the six original money laundering offences under Section 7 of Criminal Justice (Money Laundering & Terrorist Financing) Act 2010, in addition to three new counts under the Finance Act 2008.

Dominic McGinn SC, prosecuting, told the three-judge court on Tuesday that he proposed that each accused be recharged on the money laundering charges and then be charged for the first time with a series of additional revenue offences.

Detective Sergeant Adrian Buckley told the non-jury court that he had met both accused in the confines of the court on Tuesday morning and handed them a copy of the charge sheet.

The couple were both re-charged with converting, transferring, handling, acquiring, possessing or using property, namely funds lodged to an AIB account on dates between January 1st, 2018, and December 31st, 2019, within the State, knowing or believing or being reckless as to whether the property was the proceeds of criminal conduct.

Mr Kinsella and Ms Dunne, whilst having an address at Tasaggart House, Saggart, Co Dublin, were both also charged with failing without reasonable excuse to deliver to the Revenue Commissioners a full and true return for the purposes of capital acquisitions tax as required by section 46(2) of the Capital Acquisitions Tax Consolidation Act 2003 on or before October 31st, 2018.

They were each further charged with two additional counts of the same offence on or before October 31st, 2019, whilst having an address at Alpine Heights, Clondalkin, Dublin 22, and on or before October 31st, 2020, whilst having an address at Richmond, Newtownpark, Blackrock, Co Dublin.

New books of evidence were served on each of the accused.

Diarmaid McGuinness SC, representing Mr Kinsella, told the court on Tuesday that his client has a serious medical condition which has not responded to treatment and that he had a relapse last week. The barrister submitted documentation to the three judges.

Last March, counsel for Mr Kinsella informed the court that there was "a factor" relating to his client's health which might impact on having "full sitting days" during the proposed five-week trial.

A trial date for Mr Kinsella and Ms Dunne was originally fixed for Tuesday but it is expected that the case will not now commence before the Special Criminal Court until next Monday.

Mr Kinsella and Ms Dunne, who were present in court, were remanded in custody with consent to bail until Thursday, when their case will be mentioned.
