Publicans tonight issued a stinging criticism of the final guidelines which detail how they are expected to implement the smoking ban.

Publicans tonight issued a stinging criticism of the final guidelines which detail how they are expected to implement the smoking ban.

With just 10 days to go before the ban is implemented in workplaces throughout the Republic, the Vinters’ Federation of Ireland (VFI) claimed the guidelines published by the Government had merely increased their concerns.

After a meeting in Portlaoise, members said they had no further insight on how the ban should be effectively enforced, branding the guidelines “unhelpful, confusing and contrary to the law.”

The VFI, which has 6,000 members, also insisted that publicans “cannot and must not” be held responsible for the actions of their customers.

In a statement they said to do so makes a mockery of both civil and criminal law.

“The smoker must be made responsible for his or her actions, not the publican, or anybody else,” it read.

“We are deeply disappointed that (health) minister Michael Martin and the Government insists on railroading this ban through in its current form. Our members face a very difficult time ahead.”

Joe Browne, VFI president said despite their concerns the Federation was a “responsible body” and would not advise members to break the law.

He said they had advised their members accordingly.

The National Executive Council decided the Federation would legally defend members unfairly treated or prosecuted.

They also promised to re-examine the “justice of this legislation” in the near future, when they can fully assess the full impact of any loss of business.
