The Department of Health had failed to notify other EU states of its new regulations, and must now wait for up to six months to get them through.

Labour spokeswoman Liz McManus says Minister Micheal Martin must take responsibility for the blunder.

"The legislation has now fallen, the tobacco companies have come out triumphant and it really does undermine his credibility, not as any great champion, but as a minister just doing his day to day job."
