Liam Lawlor's widow has failed in her bid to prevent the Quarryvale II module of the Mahon Tribunal from going ahead on Monday.
Hazel Lawlor of Somerton House in Lucan had sought the stay, pending the outcome of her judicial review challenge to the inquiry making findings against herself or her late husband.
Mr Justice Iarliath O'Neill refused Hazel Lawlor's application for a stay on Quarryvale II saying she was not the only person affected by it.
He said other people want an opportunity to deal with allegations made against them which they have been denied since November 2005 because of the Owen O'Callaghan challenge.
He said the Oireachtas and the public were entitled to know the outcome of the inquiry in a timely fashion,
This means the module which will deal with the rezoning of land in west Dublin can go ahead on Monday with the Taoiseach second on a list of 130 witnesses.
Meanwhile Mrs Lawlor is expected to go ahead with her judicial review challenge in which she will try and prevent the inquiry from making findings of serious misconduct against her or her husband unless proven beyond reasonable doubt.
However, today the judge said her challenge cannot encompass past grievances of her late husband.
