A mechanic who suffered a catastrophic brain injury when the the car in which he was a passenger collided with a lorry has settled his High Court action for €6.5m.
Adrian Timmins, his senior counsel Diarmuid O’Donovan told the High Court suffered life changing injuries in the heavy impact crash six years ago.
"It is fair to say his life has been devastated," Counsel added.
Adrian Timmins. Lahernahone, Ballyconnell, Co Cavan had through his mother Mary Timmins sued the driver of the car in which he was a passenger, Colin Brady, Drumnoose, Milltown, Belturbet, Co Cavan as a result of the accident near Aughakillymaud Road/ Derrylin Road, Enniskillen, Co Fermanagh on April 10, 2011.
He claimed that Mr Brady drove at excessive speed and failed to slow down or halt his vehicle or keep it under control and on the correct course ont he public highway.He also claimed Mr Brady drove in a dangerous, careless , reckless or negligent fashion the consequence of which was his losing control of his vehicle.
He further claimed the impact damage was so severe it took almost an hour to remove Mr Timmins from the vehicle for transfer to hosptial.
Mr Justice Kevin Cross was told liability was admitted in the case .
Mr O’Donovan told the court that Mr Timmins had worked as a mechanic in his father’s business and it had been hoped he would eventually take it over.He said Mr Timmins had been wearing a seatbelt at the time of the accident.
Approving the settlement Mr Justice Kevin Cross said Mr Timmins had suffered devastating injuries through no fault of his own as he was a seat belt wearing passenger in the vehicle. He said the accident had a devastating effect on him and everybody in his family. He wished mr Timmins well for the future.
