Brain-damaged boy awarded €4.7m in settlement with hospital
The High Court has approved a €4.7m settlement to a 10-year-old boy from Cork with irreversible brain damage.
It was alleged in this action against Bon Secours Hospital, Cork that Colm Daly from Glasheen suffered profound intellectual and behavioural problems because he had received no vitamin K injection after his birth in June 2000.
The hospital has made no admission of liability.
Colm was described in court as a "beautiful, handsome 10-year-old boy with profound intellectual and behavioural problems" that will require lifelong supervision
His father Diarmuid, a psychiatric nurse, alleges that he was present at his son's delivery in the Bon Secours hospital in June 2000 and that no vitamin K injection was given after the birth.
The court heard the family were on holidays around a month later in Bantry when he had to be rushed to hospital with a burst blood vessel in the brain
It was told Colm subsequently suffered catastrophic injury, including for a while uncontrollable epilepsy
Mr Justice Vivian Lavan told the Dalys "you've been through a tough time" as he approved the €4.7m settlement.
