Rape accused claims he had 'consensual' sex with woman

The landlord accused of raping his tenant hours after she moved in told gardai they had consensual sex twice that night after she asked him to play a taped love song several times.

He also handed in a long letter to gardai giving his version of their meeting and how they made love in the only bed in the house with her "bouncing all over" him on top some of the time.

He said they later slept back to back and she snuggled up to him for heat several times after she jumped back into bed following visits to the toilet.

The 32-year-old Dublin man denies raping her on October 18, 2000 in a west Dublin location.

The now 22-year-old woman told him she was pregnant at the time and had given up drugs before meeting him.

He said she agreed to pay Ir£40 weekly rent to him after her aunt saw his notice offering the room.

The accused told gardai he offered the room to a single girl or single mother because he was lonely living on his own after he had separated from his wife.

He had decided he wouldn't have a man in the house because his experience from being homeless was they were "scum".

He said that he and the alleged victim walked hand-in-hand to a nearby all-night petrol station shop to buy cigarettes after their first lovemaking session and she said they should continue where they left-off on their return to the house.

The accused also claimed the woman asked him not to tell her aunt the next day that they had slept together and thanked him later after winking at him for what he said to her aunt.

He told gardai in his statement that she was to return the next day with her belongings but never turned up.

The hearing continues before Mr Justice Paul Carney.
