The Tánaiste Eamon Gilmore says the case of Marie Fleming and her medical card shows the "cold system" needs to be addressed.
It comess after the Wicklow woman's partner revealed the HSE demanded documented proof that the terminally ill woman is dying, as part of a review of her medical card.
However the HSE has now told Marie she can keep her medical card, and that the request for documentation was only made as part of a routine procedure.
Mr Gilmore said: "I'm not happy about what happened, I'm glad that the HSE has confirmed she is retaining her medical card.
"But I think it does show that the system can be quite cold at times and I think that that is something that we have to address."
