Lawyers seeking the release of an infant from HSE care have said they are concerned the mother and child relationship is being damaged.
The Supreme Court said it will fix the earliest possible date for an urgent appeal against yesterday's High Court ruling which found that the baby boy is being lawfully held away from his parents.
This Thursday the District Court will review the case.
The baby boy was just one day old when he was taken from his parents over serious concerns that he may be at risk, particularly from his father’s alleged anger and potential violence.
His lawyers want the Supreme Court to urgently hear an appeal challenging the validity of last week’s emergency care order, which was yesterday upheld by the High Court.
They are concerned that mother and baby are at a disadvantage if they remain apart going into Thursday’s hearing, when a new order is due to be made.
The Supreme Court has acknowledged the urgency of the case but said it is not in a position to hear an appeal prior to the District Court proceedings.
