Kyzysztof Holynski, aged 27, of 1 Chestnut Avenue, Fota Rock, Carrigtwohill, was arrested and charged with having cannabis resin at his home address on Saturday, September 6, being in possession of the drugs a time when their street value exceeded €13,000.

€13,000 is the threshold figure for the mandatory sentencing of up to life imprisonment or a minimum of ten years on conviction, unless a judge finds there are exceptional circumstances that enable him to depart from the mandatory provisions.

Garda Daniel Holland said the gardai were opposed to bail being granted to the accused man who was before Cork District Court today.

“One of the grounds for objecting to bail is the seriousness of the alleged offence. It is alleged that during a search of the home of this Polish national at 1 Chestnut Avenue, Fota Rock, on September 6 under the Misuse of Drugs Act over €70,000 worth of cannabis resin was found in his bedroom.

“The second ground for objecting to bail is that this man is a Polish national and has no ties to the jurisdiction. We feel that if granted bail he would abscond,” Garda Holland said at Cork District Court.

Donal Daly, solicitor, represented Holynski on free legal aid and said the accused had been living in Ireland for the past two years and had been working as a motorcycle courier at Little Island up to a fortnight ago when he suffered a serious head injury in a road traffic accident.

“During discussions with him at the weekend it was as plain as day that he was in need of further medical treatment,” Mr Daly said.

The solicitor said that no only did Holynski intend to stay in Ireland to face the case against him but he was in no fit condition to travel anywhere anyway.

The defendant said through an interpreter that he had one operation on his head since the motorcycle accident last month and he was told that he required further surgery.

Judge Uinsin MacGruairc refused to grant Holynski bail and he remanded him in custody to appear at Cork District Court again on Wednesday.
