The ‘Milk’ actor could be jailed for up to 18 months if found guilty of criminal battery and vandalism in relation to an incident last October.

The 49-year-old star was detained by police after allegedly hitting and kicking the photographer several times before breaking his camera.

He is expected to be arraigned on March 22 over the misdemeanour offences.

Meanwhile, Penn is returning to Haiti this weekend.

The actor – who has already spent three weeks in the Earthquake-stricken nation – hopes to do what he can to help survivors before expected storms hit and cause more damage.

He said: "We have to save Haiti. Relocation is, right now, the primary focus."

Sean admits he has been so affected by what he has already seen in Haiti, he may quit his role in the ‘Three Stooges’ movie.

He said: “I'm not in a very funny state of mind right now."

The Oscar-winning star has a history of violent confrontations with photographers.

In 1987, he was sentenced to 60 days in jail, serving roughly half that time behind bars, after attacking a photographer on a film set.
