An appeal against the sentence handed down to a man who raped his girlfriend while she slept in their Dublin home will be heard in February.
Magnus Meyer Hustveit returned to his native Norway after he was handed a fully suspended sentence in July.
His victim, Niamh Ní Dhomhnail, waived her right to anonymity so her 25-year-old abuser could be named in public.
The 25-year-old Norwegian national told the victim in an email after the abuse came to light that he had been using her body for "gratification" for nearly a year.
The DPP will argue that the seven-year suspended sentence was "unduly lenient".
In the July sentencing, Judge Patrick McCarthy said there was no precedent for the case and he had to take into account that the crime would not have been possible to prosecute without Mr Hustveit's admission.
