Organisers of the controversial Seanad by-election have rejected calls to expel Fine Gael's candidate from the race.
The returning officers say John McNulty will continue to be a candidate - even though he is no longer a director of the Irish Museum of Modern Art.
John McNulty's nomination form gave his membership of board of IMMA as one of the reasons he was eligible to run on the cultural panel.
But because he resigned that role yesterday, a rival candidate says he now be deemed ineligible to run.
Last night, independent Gerard Craughwell, who has the backing of Fianna Fáil - said he had officially asked for Mr McNulty to be expelled from the election.
However, it is understood the request has been rejected and that Mr McNulty will still be eligible for election.
Ballot papers are being issued this morning. A total of 164 TDs and 59 Senators to decide the future of the seat.
