Ruling in Alan Shatter case may be appealed further, says legal expert
A legal expert has said that the Court of Appeal's ruling in the Alan Shatter case is dramatic and may be appealed further.
The court yesterday upheld an appeal by the former Justice Minister, who said that he should have been interviewed before the release of the Guerin Report.
The publication of the report two years ago prompted his resignation as Minister, but his handling of the issues concerned was later vindicated by a Commission of Investigation.
Dr Tom Hickey of DCU said the court's decision is a significant one.
"It may well be the case that Sean Guerin consulted Alan Shatter, you know, as a matter of courtesy or maybe even to do the job well, but that judges would subsequently quash the findings based on the idea that they feel that he ought to have, I think, really is really quite a robust step taken by the judiciary," he said.
