Court rules against woman in eye loss case

The High Court has ruled against a 27 year-old woman who sued her boyfriend's parents after losing an eye in an accident at their home.

Elaine Newman formerly of Mullingar, Co Westmeath was looking for damages of €200,000 from Patrick and Marie Cogan arising from her injury at their house in Delvin, Co Meath in June 2007.

Elaine Newman lost an eye when her boyfriend Emmett tripped while on crutches and crashed his hand containing a bag of frozen meat through a glass door panel.

It shattered explosively and a shard of glass shot into her right eye which has since been replaced by an artificial eye.

The accident happened 5 years ago at his parents old style farmhouse in Co Meath.

27 year-old Elaine sued for negligence arguing that the glass put in by her boyfriend's father, Patrick Cogan was unsuitable.

However she's lost as the court has found an amateur couldn't be expected to know technical aspects of glazing and that reasonable care had been taken.

She also has to pay the costs of the action which are on hold in case she appeals.
