Court of Appeal reserves judgement on Shatter objection to High Court Guerin report ruling

The Court of Appeal has reserved judgement in Alan Shatter’s attempt to overturn a decision not to quash certain parts of the Guerin report.

The former Minister for Justice was heavily criticised for his handling of allegations of Garda misconduct, but claims he was denied fair procedures.

Shatter stepped down as Minister for Justice in the wake of Sean Guerin’s report in May 2014.

The barrister found he had failed to properly investigate allegations of corruption and malpractice in the Cavan/Monaghan Garda division.

He also concluded that he appeared to accept the Garda Commissioner’s version of events without question.

Mr Shatter has said was not given an opportunity to tell his side of the story and wants the Court of Appeal to overturn a High Court decision not to quash certain parts of the report.

He claims he was denied his right to fair procedures and suffered both professionally and personally as a result.

Counsel for Mr Guerin said there were other things going on in the lead up to his resignation and claims he stepped down before reading the full report.

The three-judge panel has reserved its judgement with the promise it will deliver it as soon as possible.
