Spector's ex-lawyer refuses to testify

Phil Spector's former lawyer may be held in contempt of court after she yesterday refused to testify at the music producer's murder trial.

Sara Caplan told the Los Angeles hearing she cannot testify about what she saw during a search of Spector's Alhambra, California home because she is covered by lawyer/client confidentiality.

However, Judge Larry Fidler rejected Caplan's reason not to take the stand.

He said: "My sense of justice is not only to Mr. Spector… but also to Miss Clarkson and to justice herself. She went to a scene and said she saw (someone) manipulate, conceal or destroy evidence. There is no privilege not to testify."

Last month, Caplan testified at an evidentiary hearing and claimed she saw forensic scientist Dr. Henry Lee remove a small white object during a search of the area where actress Lana Clarkson's body was found the day after she died.

Earlier, the court heard further testimony from Detective Mark Lillienfeld, who said the minute he saw Clarkson's body he thought she had been killed and that her death had "sexual overtones".

Spector is accused of the fatal shooting of Clarkson at his home in February 2003. He has pleaded not guilty and claims Clarkson committed suicide.

The trial continues.
