Lawyers for two well-known businessmen will this morning mount a legal challenge to the decision to involve a former Tánaiste in the Moriarty Tribunal.

Senior counsel Michael McDowell was hired by the Tribunal to question a Danish mobile phone conusultant.

Michael Andersen was a lead consultant to the Government in the process of awarding a mobile phone licence to Esat Digifone in 1995.

The awarding of the licence is one of the matters being investigated by the Moriarty tribunal.

The Tribunal has hired the former Attorney General and Tánaiste Michael McDowell to question Mr Anderson later today.

Businessmen Denis O'Brien and Dermot Desmond were shareholders in the Esat Digifone consortium.

Their lawyers will this morning seek a judicial review of the decision to involve Mr McDowell as counsel for the Tribunal.
