Lawyers for Timothy McVeigh have said the Oklahoma City bomber is in good spirits on what was to be his execution day.
They also said he was still keeping all options open, which would include a possible appeal.
Attorney Nathan Chambers said McVeigh is taking an "active role" in deciding what to do with more than 3,000 FBI documents that should have been given to his defence team before his trial.
"His spirits are good," Mr Chambers said outside the federal prison in Terre Haute where McVeigh is being held. "He remains willing to consider all options that are available to him."
Attorney General John Ashcroft last week delayed the execution to June 11 to give McVeigh's attorneys time to review the FBI documents, which were turned over last week.
McVeigh is weighing up whether the documents provide an opportunity to raise legal challenges to his conviction and death sentence.
With the execution delayed until at least next month, schools, courts and government offices in Terre Haute opened as usual.
