A New York woman is suing a restaurant for $1.6m (€1.45m) after a waiter allegedly hurled a glass of water over her when she complained about poor service.

A New York woman is suing a restaurant for $1.6m (€1.45m) after a waiter allegedly hurled a glass of water over her when she complained about poor service.

Millicent Evans claims her nose was broken by an ice cube thrown by a waiter at Manhattan eatery Johnny Rockets.

“This was an unwarranted and cruel assault by a young man against a middle-aged grandmother,” her lawyer, Peter De Filippis, told the New York Post.

“The restaurant has done nothing to rectify it, and she did nothing to deserve it.”

He alleges when Ms Evans commented on the poor service the waiter “called her ’a bitch’ and then threw a glass of iced water in her face as hard as he could“.

Doctors said it would cost $6,400 to correct her nose following the incident in September 2000.

The restaurant fired Ramirez three days later but never offered Ms Evans an apology or payment for her medical costs, Mr De Filippis said.

A lawyer for Johnny Rockets said there was an “unfortunate incident” that management believes was sparked by some homophobic comments made by Ms Evans.

Mr De Filippis denies his client made any anti-gay comments.
