Bohemians FC are to appeal the High Court's finding in relation to the sale and redevelopment of part of its lands at Dalymount Park in Dublin to the Supreme Court.
Earlier this month Mr Justice John Edwards ruled that the club hold a section of the Dalymount lands in trust for the owners of the adjoining Phibsboro Shopping Centre, with whom the football club had been in negotiations for redevelopment works over a number of years.
The case centred on whether there was ever an agreement between Bohemian's and developer Paschal Conroy's companies, Albion Properties Ltd and Albion Enterprises Ltd, over the potential sale of a section of Dalymount adjoining the Phibsboro Shopping Centre which Albion wanted to redevelop at a cost of €200m.
The judgment is believed to have implications for an agreement between Bohemians and another developer, Danninger Ltd, about the proposed sell-off of the stadium and its relocation to a site in Castleknock.
Today at the High Court the Judge made final orders concerning the transfer of the lands in question and awarded Mr Conroy's companies their costs.
However the Judge agreed to put a stay on those orders after the court was informed that an appeal to the Supreme Court is to be made.
The Judge said that he was not surprised that his judgment was to be appealed.
While it was unusual for the court to grant a stay in light of its own decision this was an "extremely contentious" and "hard fought" case.
In the circumstances he was going to grant a stay rather than have the Supreme Court decided whether to grant one or not.
