More farming and land disputes and disagreements are likely to be solved by mediation, following the joint launch of a nationwide mediation service by IFA, the Mediators’ Institute of Ireland, and IPAV, the Institute of Professional Auctioneers and Valuers.
IPAV President Ella Dunphy said disputes have traditionally been dealt with through the legal route involving solicitors and the courts, but use of mediation is increasing, and it is arguably well suited to most disputes because it gives parties more control over the outcome.
She said the new partnership between IPAV, the IFA, and the MII, was developed over the last three years.
IPAV’s Chief Executive Pat Davitt said the mediation service can be activated by IFA members through one of the 1,100 IPAV members nationwide; online by accessing MII members directly (www.themii.ie ); or through referrals from solicitors, accountants or agri-consultants.
MII President Sabine Walsh said parties can benefit from a safe, confidential and collaborative process provided by trained and highly skilled mediators who are accredited by the MII.
Mediation is a voluntary process of conflict prevention and resolution that allows the parties an opportunity to address their issues in a confidential, private, and safe environment.
Mediators are trained in conflict resolution skills and techniques and have the expertise needed to give people the best possible opportunity to resolve their disputes.
The mediation process improves communication, narrows outstanding issues, defuses emotions, and defines areas of agreement.
Statistics show a success rate for mediation averaging 80%.
It was also announced that IPAV members will conduct a free open market rental valuation for IFA members who wish to rent their lands.
