Man awarded €125,000 after dismissal

A man who was dismissed from his job on disability grounds has been awarded a total of €125,000 by the Equality Tribunal.

A man who was dismissed from his job on disability grounds has been awarded a total of €125,000 by the Equality Tribunal.

The man was employed by Aviance UK as a ramp supervisor.

He was on sick leave for about a month after sustaining an elbow injury at work when he was asked to attend the company doctor, who raised concerns about his cardiac condition.

He had undergone a number of cardiac procedures and the doctor declined to certify him fit for work, meaning he was ultimately dismissed on medical grounds.

The equality officer investigating his case, however, found the company had failed to reasonably accommodate his return to work.

The man was awarded €65,000 for loss of earnings resulting from the discriminatory dismissal and €60,000 as compensation for stress suffered as a result of his treatment.
