The Supreme Court has ruled this afternoon that certain parts of the 1997 Electoral Act are unconstitutional.
In upholding a previous High Court decision, the ruling found outgoing TDs and Senators have an unfair advantage over non-Oireachtas members in terms of personal spending limits during an election.
Des Kelly, a Fianna Fail candidate in the recent general election, who took the case, said that elections must be fought on a fair and even playing pitch.
"Moving on from here elections have to be fought on a fair and even playing pitch. I support the whole concept of spending limits but spending limits must be there for everyone not just new candidates coming into the field," he said.
The Department of the Environment is seeking legal advice following today's decision.
