The Supreme Court has overturned a High Court ruling which found that the Minister for Justice had unlawfully breached the rights of several Irish-born children by refusing their parents applications to remain here under the Irish Born Child Scheme.
The decision related to non-Irish-national parents of children born here before January 1 2005 but this outcome is said to have implications for hundreds of cases.
The Minister appealed last year's High Court decision and today the Supreme Court found that he had acted within the terms of the scheme.
It found that in the cases of the five people who applied under the scheme they did not meet the criteria set out.
These include making the application within a specified timeframe, a requirement of continuous residence and not being involved in criminal activity.
