The Mahon Planning Tribunal was granted two injunctions by the Supreme Court today stopping the Sunday Business Post newspaper publishing documents circulated to a limited number of persons but directed to remain confidential in advance of a public hearing.
Today's Supreme Court order applies pending the outcome of an appeal by the tribunal against a High Court decision on Tuesday last in favour of the newspaper and rejecting the tribunal's claim for a perpetual injunction barring publication of the material.
A date for the hearing of the appeal has not yet been set but it is unlikely to be until towards the end of the year.
In December 2004, the Tribunal was granted two injunctions by the High Court preventing the newspaper publishing the material until the outcome of a full hearing. Judgment in the full hearing was given by Mr Justice Peter Kelly on Tuesday.
Today's application to the Supreme Court for a new injunction in similar terms to that granted by the High Court last December was opposed by lawyers for the Sunday Business Post.
