The jury in the trial of a Waterford chef accused of raping and sexually assaulting a then 15-year-old waitress failed to reach a verdict and was sent to a hotel overnight.
The jury of five men and seven women had been deliberating for almost five hours before Mr Justice Diarmuid O'Donovan sent it away for the night.
The 42-year-old accused has pleaded not guilty to one charge each of buggery, oral rape and sexual assault on the girl at the Waterford rugby grounds on September 3, 2000.
The trial has continued for five days and the jury will resume its deliberations at 10am tomorrow morning at the Central Criminal Court.
