Chef raped schoolgirl, court told
A Waterford chef allegedly raped a 15-year-old waitress anally and orally two years ago near the Waterford city rugby grounds after offering to drive her home from work, the Central Criminal Court has heard.
The 42-year-old man has denied one count of anal rape, one of oral rape, and a charge of sexual assault on the woman on September 3, 2000.
The now-18-year-old woman told prosecuting counsel, Mr John O'Kelly SC, that she had been working with the accused in the same restaurant for almost a year before the alleged incident.
She worked on a part-time basis with a school friend and usually stayed with her on the nights she worked. Normally she got a lift with her friend and her brother after work.
On that particular night she had refused the lift from her friend's brother and had stayed behind 'for a joke and laugh' with some colleagues. She said she had a drink or two, and they played some pool.
The accused talked about wanting to draw 'smiley faces' on her chest. She said this was a running joke between them, and other people had often heard him make the remark.
Another man, who had recently joined the restaurant as a chef, offered to drive her home but she had been advised by a female colleague as well as the accused not to accept the offer as none of them knew him well enough to trust him.
The accused himself then offered her a lift home and she accepted. He drove her to her friend's house, but stopped at the estate for only about a second before driving off again.
He drove for a good while and she did not know where he stopped. When he did, he took his seatbelt off and moved towards her. He kissed her and started fondling her. He then took off her seatbelt and tried to put his hand in her trousers.
She told the jury of seven women and five men that she was very scared at this stage and did not know what to do. He then pulled her head down on his lap and forced her to have oral sex with him.
After a few minutes of this he got out of the van and walked around to the passenger side where she was sitting. He grabbed her by the arm then and pulled her out of the vehicle.
He pulled her trousers down and made her stand against the van with her back to him before trying to penetrate her anally. She said she was "scared and sore" and asked him stop.
He did stop, but said to her: "You have to make me come", and requested her to perform oral sex on him again. She refused, and he forced her to masterbate him until he ejaculated.
He then drove her back to her friend's place where she prepared her school uniform for the first day of school term starting the next day.
