The Labour Party has urged the Government to review the provisions of the Domestic Violence Act after the Supreme Court ruled today that some aspects of the legislation are unconstitutional.
The court found that the system whereby a spouse can get a temporary barring order against his or her partner without notifying the subject of the order is a breach of one of the most fundamental tenets of the justice system – the right to be heard.
The Unmarried and Separate Parents of Ireland has already welcomed the ruling and called for a complete reassessment of existing family law.
