Former senator Ivor Callely has been granted permission by the High Court to challenge a decision where he was refused early release from prison.

Former senator Ivor Callely has been granted permission by the High Court to challenge a decision where he was refused early release from prison.

The former Fianna Fáil junior minister has six days left to serve on a five-month sentence for making fraudulent expenses claims while he was a member of the Seanad.

The Minister for Justice had refused an application from Mr Callely seeking temporary release, and also refused a second application for enhanced remission, where one-third of his sentence could be waived due to his good behaviour in prison.

But the decision to refuse enhanced remission has now been quashed, meaning the Minister must now consider a new application from the former politician.

Mr Callely remains on bail while the application is considered.
