Negotiations have failed to settle a High Court privacy action taken by Van Morrison's wife Michelle Rocca.

The former model claims Dun Laoghaire Rathdown County Council failed to protect her and her husband's privacy following a redevelopment by their neighbours in Dalkey, Co Dublin.

After a day locked in talks, the High Court was informed this evening that it had not been possible to resolve matters.

The case revolves around the rebuild of Mount Alverno next door to Van and Michelle Morrison which was described at the hearing yesterday as a 'Celtic Tiger type' house.

The singer's wife, who was in court today, claims in order to maintain privacy, trees rather than shrubs should have been planted by neighbours Desmond and Mary Kavanagh at the boundary wall.

She is challenging Dun Laoghaire Rathdown County Council's decision to grant a notice of compliance to the Kavanaghs in respect of the redevelopment.

As negotiations between the parties have failed, the hearing will now resume tomorrow morning.
