Tim Montgomery’s lawyer, Cristina Arguedas, has stated that the world number one will fight any attempt to ban him from the Olympics after it was revealed the sprinter had been notified by the US Anti-Doping Agency that he has been reported for drug violations.
The world 100-metre record-holder has received a letter from the USADA stating that they had documentary evidence against him even though he has never failed a drug test.
He is one of four top-flight athletes sent letters and more could be on the way according to the US Olympic Committee.
The evidence is said to come from documents seized by Federal investigators at the BALCO laboratory in California which is at the centre of a steroid scandal.
But Arguedas said: “Tim has been a willing participant in the drug-testing process and he has passed every test he has ever taken.
“The evidence we have been shown by USADA and are still reviewing is inconclusive and internally inconsistent.”
The US Olympic Trials take place in Sacramento, California, next month with the top three in each race qualifying for Athens and Montgomery is hoping the situation will be sorted out by then.
