The Dáil's Public Accounts Committee has been told its request for independent legal advice will be provided by the Parliamentary legal team.
The taxpayers' watchdog wanted to see if they had the power to compel former Rehab bosses Angela Kerins and Frank Flannery to appear before them.
It is after the Committee on Procedures and Privileges demanded more information on their request to compel the two to appear, but members of the PAC saw that as a signal they were outside of their remit.
The Committee is now discussing if they can still seek outside legal advice.
