The family of Michaela McAreavey is seeking compensation from the hotel in Mauritius where the Tyrone woman was murdered while on honeymoon in 2011.
The family is suing the Legends Hotel for €1.6m in damages.
The family launched court proceedings on Friday. They intend to pay any money from the case, except expenses incurred by Michaela's husband John McAreavey, to The Michaela Foundation.
The charity was set up following the 27-year-old's death to help children in need of support and education.
