The Court of Criminal Appeal has heard that "too much weight" was given to mitigating factors in the sentencing of sex attacker Anthony Lyons.
The 52-year-old businessman, with an address at Griffith Avenue, Dublin was found guilty of sexually assaulting a woman near his home in October 2010.
He was jailed for six months and ordered to pay €75,000 in compensation to his victim.
The DPP believes the punishment did not go far enough and has launched an appeal on the grounds of undue leniency.
