The Commercial Court has moved to allow IBRC cross-examine family members of jailed businessman Sean Quinn about their assets.

Lawyers for the Quinns had branded the exercise as an impermissible 'fishing expedition'.

IBRC claims Quinn family members have not been completely forthcoming in disclosing details of their assets and bank accounts.

They also have questions to put to Sean Quinn Snr’s five children and three of their spouses Stephen Kelly, Niall McPartland and Karen Woods about the control of the Quinn International Property Group and the alleged transfer of assets to off-shore companies.

Senior Counsel for the Quinns Martin Hayden branded the request to cross-examine the family on discovery issues as an unlawful fishing exercise but Mr Justice Peter Kelly has found it is necessary to “fill the vacuum”.

He said he is satisfied this does not in any way dilute or interfere with their entitlements against self incrimination.

The hearing will take place on January 24 and 25.
