Solicitor Brian O’Donnell’s legal battle over the Gorse Hill mansion in South Dublin is due for judgment at the Court of Appeal this morning.
He is appealing a High Court ruling that gave Bank of Ireland a trespass order requiring him and his wife to leave the property.
He claims he has a contractual right to stay at the luxury home and that the appointment of a receiver by the bank is invalid.
When their appeal was last heard Brian O’Donnell and his wife Mary Patricia were given a three week stay at Gorse Hill by the Court of Appeal’s three judge panel, while they considered a number of “serious issues”.
The Court of Appeal has heard submissions from the Bank of Ireland - which is owed over €70m by Brian O’Donnell - and the solicitor himself, who claims he was granted a contractual right to reside at the Killiney property by Vico Ltd.
Mr O’Donnell claims the receiver in the case was not properly appointed by the bank because the official who sealed the document was not senior enough.
The three judge panel at the Court of Appeal will render its judgment at 10am.
