Appeal Court judges in Britain, say a gagging order, banning newspapers from naming a celebrity accused of extramarital activities, should be lifted.
The man now has until Wednesday to take his case to the the UK's Supreme Court.
But his identity is already widely known after the story was published around the world and spread online.
Rhiannon Evans from Heat Magazine, says it's the latest injunction which has merely inflamed interest: "This injunction obviously has made the story bigger than it would have ever been.
"So some celebrities think, 'oh I'll get an injunction so it'll become a bigger story than before, but I think there'll always be celebrities who want to keep things out of the private eye and they'll continue to do so."
