A court has ruled that Brian Meehan can proceed with his bid to have his conviction for the murder of journalist Veronica Guerin declared a miscarriage of justice.

The Director of Public Prosecutions had applied to have the case struck out before the hearing.

The Court of Criminal Appeal has ruled that the DPP's attempt to have Brian Meehan’s case thrown out was ill conceived.

It has also refused to have a preliminary hearing to address issues such as whether his miscarriage of justice claim is an abuse of process.

The 47-year-old from Crumlin in Dublin has spent almost 15 years serving a life sentence for the 1996 murder of Veronica Guerin following his conviction by the Special Criminal Court.

He was found to have driven a motorcycle up alongside the Sunday Independent journalist’s car on the Naas Road allowing his pillion passenger to fire the fatal shots.

He said new facts have come to light that will show his conviction was a miscarriage of justice, while the DPP claim there are no new facts, and his case is wholly without merit.
