U2's Larry Mullen has failed to have legal proceedings against his accountant fast-tracked to the Commercial Court.

The drummer is suing Gaby Smyth and Company over an alleged failure to properly advise the musician in relation to investment funds.

Larry Mullen is not the first member of U2 to sue the high profile Dublin accountancy firm.

Earlier this year Adam Clayton settled a claim against the Gaby Smyth firm for alleged negligence over the embezzlement of nearly €3m by the bass guitarist's former housekeeper.

Lawyers for the drummer today made a bid for his case against the financial advisor to be fastracked into the Commercial division of the High Court.

Mr Justice Brian McGovern refused because he believed the application should've been made before now – given that the proceedings commenced over a year ago.

The court heard Larry Mullen claims he was not properly advised on some investments.
