A request to have convicted killer Catherine Nevin brought to court as part of a legal row about her husband's assets has been refused.
The 61-year-old is serving a life sentence for murdering Tom Nevin at their pub Jack White's in Wicklow in 1996.
Family members of the murdered publican Tom Nevin have brought legal proceedings to stop his widow inheriting any of his estate.
As part of their case, they are asking the High Court to admit as evidence the 61-year-old's 2000 criminal conviction for the killing.
Catherine Nevin's lawyers claim the matter should not go ahead because the criminal process is still live.
Her solicitor Ann Fitzgibbon said the 61-year-old is trying to appeal her case to the Supreme Court on a point of law of exceptional public importance.
Papers were filed with the Court of Criminal Appeal yesterday.
High Court President Nicholas Kearns has ruled that the preliminary hearing can go ahead tomorrow.
He turned down a request which would have allowed Catherine Nevin to attend court.
