Limerick murder trial hears mobile phone evidence
22/10/2012 - 17:45:59A mobile phone forensic analysis has given evidence in a double Limerick murder trial that one of the accused telephoned the partner of one of the victim four times three hours after the murders had taken place.
Garda Shane Ryan told prosecuting counsel Mr Brendan Grehan, SC, he downloaded details from the mobile phones and sim cards of murder victim Desmond Kelly, his partner Olivia Mullens and one of the accused Patrick O'Brien.
He said three of the phone calls from O'Brien's mobile phone to Ms Mullen's mobile phone occurred between 12.37am and 12.38am on January 9, 2011 had durations of zero seconds but a further phone call to Ms Mullen's phone at 12.40am lasted 110 seconds.
It was day 10 of the trial at the Central Criminal Court of first cousins Patrick O'Brien (aged 33) of Glanntan, Golflinks Road, Castletroy, Limerick and Thomas Stewart (aged 29) of The Cedar, Briarfield, Castletroy, Limerick who have both pleaded not guilty to the murders of Desmond Kelly (aged 23) and Breda Waters (aged 28) on January 9, 2011 at O'Malley Park in Limerick.
He also gave evidence that one of two mobile phones which O'Brien had, made a call to the other accused Stewart at 8.38am on the morning of the shootings.
Further evidence was given of a number of phone calls made from Mr Kelly's mobile phone to O'Brien lasting between 30 seconds and 218 seconds the night before he was shot.
The trial went into legal argument for the duration of the afternoon and Mr Justice George Birmingham sent the jury of six men and six women home and asked them to return in the morning.
