Gilmore: Government seeking legal advice over mobility allowance


The Tánaiste says the coalition needs to take legal advice over a payment for disabled people.

It comes after the Ombudsman hit out at the Department of Health saying a limit on the mobility allowance that means over 66s can't claim it, is illegal.

The €12m scheme sees 4,500 people get the allowance of €208.50 a month.

Eamon Gilmore has told the Dáil the government has to decide how to comply with the law in a way without withdrawing the payment.

"We're seeking further legal advice as to the options available to the government. It's not the government's wish to withdraw the mobility allowance from those who currently receive it.

"The government will be seeking legal advice as to how we can proceed in a way that is reasonable, sustainable and does not cause undue stress to those who receive the allowance."
