The Irish Data Protection Commissioner will examine how today's EU court ruling protecting personal information online will impact data being shared with the US.
In a statement, the Commissioner says the significance of the judgement extends far beyond the case currently pending in Ireland.
The EU's Highest Court has ruled that the data sharing agreement with the US is invalid, which could mean that information can no longer be shared across the Atlantic.
The Commissioner says today's EU judgement will be considered by the High Court in the coming weeks.
Simon McGarr, a solicitor who represents Digital Rights Ireland, says the Data Commissioner needs to look into whether information should be shared with the US.
Mr McGarr said: "It is now up to the Irish Data Protection Commission to do an investigation into how EU citizens' data is treated when it is transferred to the US and whether or not that can possibly meet with a finding of adequacy by the Irish Data Protection Commission.
"That remains to be seen. Certainly the facts recited by the court suggest that it would be considerably difficult to find that these protections are adequate."
