Dundon case adjourned again

Limerick criminal Wayne Dundon High Court action against a decision by the authorities at Cloverhill prison to isolate him from the mainstream prison population has been further adjourned after talks failed to resolve the dispute.
In his action Dundon claims he is denied access to prison educational and training facilities and that he has restrictions placed on family visits. He says his segregation is a breach of his rights.
In proceedings against the governor of Cloverhill Prison, the Minister for Justice Ireland and the Attorney General, Dundon sought orders including one that he be transferred out of the block in which he is confined to an ordinary block within the mainstream prison.
He also wanted to take part in structured activities for not less than five hours a day, five days a week.
Alternatively, he sought a transfer out of Cloverhill into an ordinary block of another prison. The State opposing the proceedings and argued that Dundon has no arguable case.
The application was before Ms Justice Maureen Clark, who today adjourned the matter to a date later this month, after Padraig Dwyer SC for Dundon said that talks between the respective parties had failed to resolve the action.
Following submissions by counsel the Judge allowed Dundon amend his original action on the basis that many of the issues raised on Dundon's behalf had now been dealt with.
The matter will now be mentioned before the President of the High Court Mr Justice Nicholas Kearns later this month.
