Court refuses Quinn bid to mount own defence

The Commercial Court has ruled Seán Quinn is not allowed defend himself in proceedings against the Irish Bank Resolution Corporation (IBRC).

The bankrupt businessman is a third party in proceedings brought by his wife Patricia and his children in which they claim they're not liable for loans of €2.3bn from the former Anglo Irish Bank.

He was brought in to the case by IBRC which claims he acted in a fraudulent manner by allegedly obtaining loans from the bank for an illegal purpose.

Mr Quinn denies this and counterclaims that the bank knew the loans were for the unlawful aim of propping up Anglo's share price.

However Mr Justice Peter Kelly has ruled that being a bankrupt, he does not have a personal entitlement to defend the proceedings in circumstances where the official appointed to take charge of his bankruptcy has refused to defend of the case.
