A judge has ruled that both sides are liable for their legal costs following the Greens’ failed legal challenge against RTE.
The Green Party mounted a legal challenge to a decision by the broadcaster not to invite their leader, Eamon Ryan, to take part in a seven way leader’s debate ahead of the election.
But RTE said the Greens did not meet the requirement that a party have at least 3 TDs in the outgoing Dail.
Ms Justice Marie Baker had found in favour of RTE, saying there was nothing unfair, irrational or disproportionate about the requirement.
However today, Judge Baker found that the issues raised by the Greens were important, and that there was some benefit to the public and the media.
She also found that RTE had fully engaged with the Greens throughout the process and praised them for their litigation behaviour.
Accordingly, Judge Baker made no order for costs.
