A pair of shorts and underwear belonging to Jason Lee showed no evidence of semen, according to testimony in Suffolk County Criminal Court in Long Island Wednesday.

A crime lab technician was giving evidence on the fifth day of the rape trial of the former Goldman Sachs banker who has pleaded not guilty to the alleged sexual assault of a young Irish woman in the summer of 2013.

The then J1 student, who had spent the summer working elsewhere in the United States, was visiting her brother in the Hamptons and met Mr Lee at an East Hampton nightclub during the early hours of August 20, 2013.

The alleged victim gave evidence on Tuesday to Judge Barbara Kahn that the defendant attacked her in a downstairs bathroom at the $33,000 a month holiday home Mr Lee was renting.

According to the young Irish woman's tearful testimony, she did not give consent, tried to push her attacker off her and kneed him in the groin before leaving the bathroom.

The defendant's lawyer stated in opening arguments last Wednesday that there was a situation in the house that night in which consensual sex can occur even if that consensual sex was ultimately regrettable.

However, Moly Philip of the Suffolk County Crime Lab's biology section, told the court on Wednesday that Mr Lee's clothes were "negative for the presence of semen".

Earlier in the day, the prosecution had Detective Charles Charff guide the court through a multitude of phone calls that were made using Jason Lee's mobile phone before and after the alleged incident.

The trial continues Thursday.
