BUPA loses High Court challenge to risk equalisation
23/11/2006 - 14:05:15BUPA has lost its High Court challenge to the controversial risk equalisation scheme.
Mr Justice McKechnie today read out 200-page judgement, and has rejected the health insurers case on a number of grounds.
Ireland's second largest insurer had argued the scheme, whereby it would be forced to pay compensation to VHI because of its young customer profile, would be illegal under Irish and European laws.
BUPA has said that if the scheme was introduced, it would force the newcomer out of the market here.
