McDowell calls on judges to consider public safety in drugs sentences

The Minister for Justice has called on judges to consider public safety when sentencing drug offenders.

He said that in 80% of cases, the minimum mandatory sentences are not imposed.

Michael McDowell was speaking on the Criminal Justice Bill 2006 which has just come into effect.

In it, provisions have been made for the judiciary of have a broader range of sentencing options.

The Minister found it hard to believe that in most drug offenders' cases, there are special circumstances which entitle them to lighter sentences.

“I find it difficult to believe that in 80% of cases, those special excusing circumstances exist.”

He added: “The recalibration of the law makes it necessary for the judiciary to look to the broader issue of the effect of drugs in society before they depart.”
